Captain Henry Brueggemann

Captain Henry Brueggemann, passed away at his home last Saturday night, 
December 29 or 30, 1916; in Alton, Illinois a day or two after his sister 
Johanna Henrietta Brueggemann (Hoffmann). (There are a few discrepancies 
here).

THE WILL OF CAPTAIN HENRY BRUEGGEMANN

Know all men by these presents, That I, HENRY BRUEGGEMANN, of the City of 
Alton, in the County of Madison and State of Illinois, being of sound and 
disposing mind and memory, and considering the uncertainty of this frail and 
transitory life, do therefore make, ordain, publish and declare this to be my 
last WILL and TESTAMENT:
As to my worldly estate and all the property, real, personal or mixed which 
I shall die seised and pos?????, or to which I shall be entitled at the time 
of ???? ??? ???? ??? manner to wit:

FIRST:-My Will is, and I so order and direct, that my Executrix, hereinafter 
named pay all my just debts and funeral expenses out of my estate as soon 
after my decease as shall by her be found convenient.

SECOND:-After the payment of such debts and funeral expenses, I give and 
bequeath to my sister MINNIE BRUEGGEMANN, the sum of ONE HUNDRED DOLLARS in 
cash.

THIRD:-To my sister Hannah (Johanna) Hoffmann, I give and bequeath the sum of 
ONE HUNDRED DOLLARS in cash. 

FOURTH:-After the payment of such debts, funeral expenses and legacies, I 
give, devise and bequeath unto to my beloved wife, Mary H. Brueggemann, for 
and during the term of her natural life, all my real and personal property of 
whatsoever kind and nature wheresoever situated, with full power to have and 
to enjoy the same, so long as she may live, and to this end she, my said 
wife, is hereby given full and completer power and authority to sell any and 
all real estate I may leave at my decease, convert it into cash, use the 
proceeds thereof, or re-invest the same. And she shall have like authority 
concerning any personal property I may leave. She shall at all times have 
authority to us the principal of moneys or funds I may leave, as well as the 
interest thereof. But I Especially charge her that she do not waste my said 
estate, and that my gifts of money or property therefrom, be limited to my 
sisters above named, as it is my purpose and desire, as hereinafter set 
forth, that after the death of my said wife that she part of my estate then 
remaining, shall ensure to the benefits of my said sisters. And I hereby 
charge my said wife, to at all times see that my said sisters are--cared for, 
that they have and enjoy what may be necessary for their welfare and comfort, 
during the lifetime of my said wife.

FIFTH:-After the death of my said wife, it is my will, and I hereby order and 
direct, that the balance then remaining of my said estate, be converted into 
cash, and that the net proceeds thereof be disposed of as follows, that is to 
say:
A. My sister HANNAH HOFFMANN, if she be then living a two-tenths (2/10ths) 
part thereof. If she be then dead, her then living children shall have a 
one-twentieth (1/20th) part of said estate, to be equally divided among them. 
B. To the then living children of my deceased sister Henrietta ILCH, a 
one-twentieth (1/20th) part of said estate, equally divided. 
C. To the then living children of my deceased brother, Louis H. Brueggemann, 
a one-tenth (1/10th) part, divided equally.
D. All the rest, residue and remainder of my said estate, shall go to and 
become the property of my sister MINNIE BRUEGGEMANN, for and during the term 
of her natural life, and she is to have the use and enjoyment thereof, 
principal and interest and what may remain thereof, if any, at her death, 
shall be disposed of as follows, that is to say:
1. One-Half (1/2) thereof to my sister HANNAH HOFFMANN, if she be then 
living.
2. The other, and remaining one-half (1/2) shall become the property of 
the children of my deceased brother LOUIS H. BRUEGGEMANN, and the said last 
named children, shall in addition thereto, have the one-half of said property 
herein ????? bequeathed to my sister HANNAH HOFFMANN, should she not be 
living at the death of my said sister MINNIE BRUEGGEMANN.

SIXTH AND LASTLY:-I make, constitute and appoint my beloved wife, MARY H. 
BRUEGGEMANN, to be the Executrix of this, my last will and Testament, hereby 
revoking all former Wills by me, at any time, made. And it is my espeical 
request and desire that she so act in the premises without bond.
And in the event of the death of both my said wife and my said sister, then 
the Probate Court of Madison County, shall appoint an Administrator with this 
will annexed to take charge of my said Estate.
IN TESTIMONY WHEREOF, I, the said HENRY BRUEGGEMANN, have to this, my 
last Will and Testament, consisting of Three (3) typewritten sheets of paper, 
subscribed my name and affixed my seal, this 12th day of January A. D. 1914.

THIS IS TO CERTIFY, that the forgoing instrument, was, on the day of the date 
thereof subscribed, published and declared by the said HENRY BRUEGGEMANN, as 
and for his last Will and Testament, in the presence of us, who, at his 
request and in his presence and in the presencea of each other, have 
subscribed our names as witnesses thereunto, hereby also expressing our 
belief, that the said HENRY BRUEGGEMANN, Testator, was, at the time of his so 
signing, sealing, publishing and declaring the foregoing Instrument, as and 
for his last Will and Testament, of sound and disposing mind and memory, and 
of legal age. Done in the said City of Alton, this 12th day of January A.D. 
1914.
